These Terms apply to all the Services we provide to you through our Site and other platforms. These Terms contain details of each of our Services, the use and limits of our Services and of our liability to you and your and our rights and obligations in relation to the provision and use of the Services.
Above all, it is important that you are aware that our Services are provided for informational purposes only, and do not constitute professional medical advice, diagnosis, therapy or treatment. Our Services are not a substitute for professional medical advice, diagnosis, therapy or treatment. WHO WE ARE
METACOGNITIVE THERAPY AS is incorporated and registered in Norway with company number 933180182 whose registered office is at Universitetsgata 24, 0162, OSLO, Norway, is offering its Services which may be branded as MetacognitiveTherapy.com and/or No Worries (''we'', ''us'').
Metacognitivetherapy.com ("Site") is a public website with the primary purpose of educating the visitor about topics related to metacognitive therapy (MCT), and to share personal experiences from individual therapists in treating associated mental disorders. The secondary purpose of the website is to connect visitors with therapists that offer consulting services through Metacognitive Therapy (“Matchmaking”). The services (cumulatively referred to as our ''Services'' or individually as a ''Service'') include Matchmaking, and our Blog, our Digital newsletter, our Emails, our Digital media, in the form of illustrations, text, video and audio.
OUR RELATIONSHIP
These Terms of Service and our Privacy Policy (collectively, the ''Terms'') govern your use of Services and your relationship with us. It is important that you read and understand in full the Terms before you start using our Services. To access our Services, you will need to access the Web App on our Site and actively accept our data processing practices, privacy policy and these terms. By actively confirming these terms you confirm that you agree with the Terms. If you do not agree to these terms or our data processing practices, you should not use our Services. You must be capable in your country of residence of entering into a legal binding agreement to use our Services in your country of residence.
Additional Users. We only allow you to use our Services as additional users (third parties) if you are a legal guardian of a person signed up to use our services (“User”), meaning you have the legal authority to care for the personal and property interests of a User. If you are not a legal guardian of such a User, you are required to sign up for our Service and create your own account. We do not store data for additional users.
Security. You are responsible for maintaining the confidentiality of your login details and any activities that occur within your Account. We currently do not provide additional password security apart from the credentials which you registered yourself with, so bear this in mind when signing up to our Services and allowing the usage of our Services or your account to third parties. If you have any concerns that your Account may have been misused, you should contact us without delay and inform us of such.
METACOGNITIVE THERAPY AS AND THIRD PARTY CONTENT
Metacognitivetherapy.com content means every content available on the Site, articles or any other Service. We release new content through a number of channels including our blog, digital newsletters, videos, audio and written media. Such content is distributed through content distribution channels owned by us, and distributed through third-party channels including social media platforms. You can find various health related articles, reviewed by our team of mental health professionals.
Third Party content means products or services which are offered or provided by third parties and/or links to such content within our Services. When clicking on or otherwise engaging with third party content, third party terms and privacy policy apply. We are in no way responsible for the actions of these third parties, the content of their sites, their products or services, the use of the information you provide to them, or any of the products or services they may offer and no agency relationship exists between us and the third parties.
PAYMENTS AND ACCESS
Payment Processors. Payments will be processed through Stripe, Inc. We encourage you to learn about the applicable policies directly from Stripe. In no event will Metacognitive Therapy AS be responsible for the actions or inactions of any third party payment processor, including, but not limited to, system downtime or payment services outage or refusal of service by said third-party company.
You acknowledge and agree that all billing and transaction processes are handled by Stripe, Inc. and are governed by the provider's terms and conditions/EULA. Metacognitive Therapy AS itself does not collect or store payment card information.

All our Services are offered and available to users who are 18 years of age or older. By using the Services, you represent and warrant that you meet the foregoing eligibility requirement. If you do not meet this requirement, you must not access or use the Services.

It is your responsibility to ensure this information is correct and complete, and you accept that any failure to do so (whether intentionally or not) may affect the information we can give to you, and may have consequences for which we are not responsible. If we receive an email or webform submission that includes questions about your health, medical problems and/or conditions/symptoms we may send out a standardized notice informing you that we do not provide this type of information via email.
Right to deny access. Metacognitive Therapy AS reserves the right to deny any or all access to the Service to any User for any reason, at any time, at our sole discretion. You confirm and agree that we may block your access at any time, and at our sole discretion we may disallow your continued use of the Site or the Content without notice. We reserve the right to take any action we may deem appropriate in our sole discretion with respect to violations or enforcement of the Terms of Service, and we expressly reserve all rights and remedies available to us at law or in equity.

We generally welcomes links to its content and Services (e.g. Site, Blog, etc.) You may establish a link to our content and/or Services, provided that the link does not state or imply any sponsorship or endorsement of your website or its contents by Metacognitive Therapy AS or make any representations on warranties on our behalf.
USAGE OF OUR SERVICES THROUGH SOCIAL MEDIA: When using our Services through social media, note that the information you share including health data will be processed by the social media provider and might be used to build a profile of you and could result in receiving adverts including relating to health issues. This processing is not controlled by us and we do not have access to the data stored within social media about you.
REVIEWS, COMMENTS AND FEEDBACK: When submitting reviews, social media posts, feedback, comments and suggestions for improvements to our Services (“Review”) by providing us a written message review and/or by posting a public Review on a third party site such as Trustpilot or Google Reviews, you hereby grant us the worldwide, non-exclusive, perpetual, royalty-free license under any and all intellectual property right that you own or control, to use, copy, publish, display, reproduce, translate, modify, and/or commercially exploit your Review, together with your name, on our Site, social media or any other platform that we use to promote our Services. We will never edit a Review in such a way as to create a misleading impression of your views. USAGE OF THE MATCHMAKING PLATFORM
Via our Matchmaking Platform (“Platform”) visitors of our Website can find a selection of therapists that offer one-on-one counseling which can be purchased by the visitor. In this context a therapist is an individual or legal entity listed on the Site as a practitioner specialized in Metacognitive Therapy (“Therapist”) that offers counseling sessions to clients. In this context a client is the party on the receiving end of the counseling (“Client”).
The Platform services include:
- Hosting of information concerning therapist availability,
- Therapist-provided biographies and practice approach, and general information concerning in depth online counseling.
- Counseling session scheduling, schedule notification.
- Hosting of a messaging service allowing communication between clients and therapist.
- Hosting of video sessions through third-party provider service allowing communication between clients and therapists.
- Invoicing through third-party provider service allowing communication between clients and therapists.
METACOGNITIVE THERAPY AS WILL NOT OFFER COUNSELING OR THERAPY SERVICES ITSELF. NEITHER WILL IT REPRESENT THE CLIENTS OR THE THERAPISTS WITH REGARD TO COUNSELING OR ANY OTHER ACTIVITY. RATHER, THE COUNSELING RELATIONSHIP INCLUDING ALL CONTRACTUAL OBLIGATIONS ASSOCIATED WITH IT WILL OCCUR SOLELY BETWEEN THE CLIENTS AND THE THERAPISTS.
CONDUCT: As a consequence, only the respective therapist, not Metacognitive Therapy AS, shall be responsible for the proper conduct of the counseling and all related duties. Correspondingly, only the respective client, not Metacognitive Therapy AS, shall be responsible for his communicative input and liable for due payment of the fees agreed with the therapist.
VENUE OF COUNSEL: The legal venue of the counseling session of the Client is determined by the registered location of residence of the Therapist. The Client can obtain this location by visiting the Therapist’s profile on our Website. The Therapist ensures to promptly communicate to Metacognitive Therapy AS any errors or relevant changes in the location as displayed on the Therapist’s profile, and regularly checks that the Website reflects the correct registered location of residence of the Therapist.
REGISTRATION PROCESS: The use of the Platform for communicative purposes requires online registration. Registration shall be free of charge for clients. Users of the Platform must be at least 18 years of age and contractually capable. Furthermore:
- All data requested by Metacognitive Therapy AS has to be submitted truly, accurately and completely.
- Upon registration, clients and counselors shall choose a member’s name (potentially their natural name) as well as qualifying credentials to protect and access their account. They shall keep their password confidential, secure their access to the Platform and notify Metacognitive Therapy AS immediately of any suspected unauthorized access.
- Counselors have to provide Metacognitive Therapy AS during the registration process with evidence of qualification and/or education. Metacognitive Therapy AS reserves the right to check this information or to request further proof. No one shall have multiple accounts.
APPLICATION AND ON-BOARDING: The Platform operates on an apply-only basis for therapists seeking to join. During the onboarding process, the Platform conducts a thorough review of the applicant’s qualifications, including diplomas and experience.
The onboarding process also includes a subjective assessment by the Platform to determine the therapist's compatibility with the Platform's values and standards. This assessment is based on factors including but not limited to professional demeanor, communication skills, and alignment with the Platform's mission.
LEGAL COMPLIANCE: By registering to the Platform, Therapist acknowledge and agree to comply with all applicable laws, regulations, and ethical standards related to their professional practice.
QUALIFICATIONS AND INSURANCES: Therapist shall bear the responsibility for obtaining, upholding, and financing any and all documentation, qualifications and insurances to legally operate within the qualification of Therapist. In the event that the Therapist specifies in their public profile to possess a valid qualification for a profession that requires a state authorization in any country the Therapist shall at all times ensure that said authorization is valid and communicate clearly any limitations to said qualification. This includes specifying the countries in which said authorization is valid. In case the validity of said authorization expires the Therapist shall immediately seize any ongoing counseling with Clients and at the first opportunity inform Metacognitive Therapy AS about the expiration of said authorization.
ETHICS AND EXCLUSION: Metacognitive Therapy AS reserves the right to terminate contractual relations pursuant to the Terms and to deny clients and/or the Therapist access to the Platform without giving further reasons. Metacognitive Therapy AS reserves the right to assess and evaluate Therapist’s qualifications to ensure alignment with our values and standards. Therapist understands and agrees that failure to meet these standards may result in exclusion from the Platform.
Therapists on the Platform must adhere to the high level of professional ethics and conduct that may be expected from healthcare professionals. Any behavior or practice deemed unethical or in violation of the Platform's values may result in the termination of the therapist's account. The Platform reserves the right to exclude any Therapist, at its sole discretion, who is found to breach professional ethics, fail to meet required qualifications, or otherwise does not align with the values and standards of the Platform. Exclusion decisions will be made by the Platform after a thorough review of the Therapist's conduct, taking into account relevant information and considerations.
The Platform reserves the right to modify these terms, including the Therapists qualification requirements, at any time. Therapists will be notified of any changes, and continued use of the Platform after such modifications constitutes acceptance of the updated terms.
Exclusion decisions will be made by the Platform after a thorough review of the therapists conduct, taking into account relevant information and considerations.
The Platform reserves the right to modify these terms, including the Therapist Qualification and Conduct Clause, at any time. Therapists will be notified of any changes, and continued use of the Platform after such modifications constitutes acceptance of the updated terms.
FURTHER OBLIGATIONS: The Client and Therapist shall refrain from any misuse of the platform. In particular, they shall not:
- Use the platform to obtain any services that are against the law or otherwise prohibited in the location where client is accessing services;
- Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others on the platform;
- Send or otherwise make available any inappropriate, profane, defamatory, obscene, abusive, racist, indecent or unlawful topic, name, material or information on the platform;
- Send files that contain viruses, Trojan horses, worms, corrupted files, or any other similar software or programs that may damage the operation of another’s computer or property of another;
FEES, CHARGES AND BILLING: Visit to and use of the Platform as well as registration will be free of charge for the clients. The counseling services itself shall be chargeable by an agreement between the client and the therapist. Metacognitive Therapy AS may collect the funds from the Client on behalf of the Therapist. The registration and use of the Platform will be charged for the Therapist. Prior to the chargeable service, Therapist will be advised of this fact as well as the amount or rate of charges.
Fees for counseling shall be set individually by each therapist. The therapists may modify this fee over time at their own discretion. The therapist shall state his personal fee per reference time in his profile. Charges to Clients may be charged in any currency while the payout to Therapists shall be in Euros. Only the fee stated in this way will be chargeable by the therapist.
Visit to and use of the Platform as well as registration will be free of charge for the clients. The counseling services itself shall be chargeable by an agreement between the client and the therapist. Metacognitive Therapy AS may collect the funds from the Client on behalf of the Therapist. The registration and use of the Platform will be charged for the Therapist. Prior to the chargeable service, Therapist will be advised of this fact as well as the amount or rate of charges.
The infrastructure for the payment of counseling sessions (“Sessions”) shall be facilitated by the Platform. Payments are authorized by Client prior to each session occurring by entering Client's electronic payment information. All payments by Clients will be processed by an external payment service company registered and monitored as a payment institution under the European Payment Service Directive (2007/64/EC).
For Client users:
- The Platform is free for the Client users. All the fees charged using the integrated billing infrastructure are at the Therapists’ discretion and are payable directly to them. It is the Therapist’s responsibility to charge, track, and report any VAT that may be owed for the service provided through the platform. Disputes concerning payment and/or quality of service delivery shall be taken up with the Therapist directly.
For Therapist users:
- Fees for counseling shall be set individually by each therapist. The therapist may modify this fee over time at their own discretion.
- The Platform may charge the Therapist a service fee (“Commission”) by deducting a fixed amount or percentage of the payment for sessions with Clients.
- The Counselor authorizes the Platform to automatically charge all applicable fees from Clients on their behalf. Furthermore Therapist authorizes the Platform to deduct service fees (“Commission”) directly from the payment made by Client for Sessions with the Therapist. The funds owed by the Platform to the Therapist are paid out on a monthly basis following the Platform's internal administrative routines.
In case the Client issues a request for refund the Platform is authorized to grant or refuse such request on behalf of the Therapist. The Platform may base its decision based on its internal administrative routines. Any transaction fees charged by the Platform’s external payment providers in relation to said refunds may be withheld from the refunded total amount.
LIABILITIES: Metacognitive Therapy AS offers a communicative forum without guaranteeing any type of success, gain, relief or similar effect to the client. Metacognitive Therapy AS will aim to make the platform's services available in the best possible quality. Any liability shall be excluded in the event of failure of communication networks, gateways, force majeure or other events outside the control and responsibility of Metacognitive Therapy AS. Likewise, any liability shall be excluded in case of unlawful or unallowed access by third parties to the platform or the counseling process by means of hacking or similar means. Metacognitive Therapy AS will be liable for damages for other than the above-mentioned reasons only in case of intent or gross negligence by its managers, officers, employees or agents and only in the proportion such behavior has caused the damage in relation to other causes. This limitation does not apply in case of a violation of cardinal duties, i.e., duties the fulfillment of which the clients may justly expect. No loss of profits shall be recoverable. The restrictions of liability do not apply to cases of damages to life, body, or health, to cases of warranting for the condition of a product, and to cases of fraudulent concealment of defects of Metacognitive Therapy AS, its legal representatives or assistants in performance. If a Client has a concern or complaint about a therapist working on the Platform and feels unable to direct the complaint to their therapist, or if he/she receives an unsatisfactory reply from the therapist, the Client should contact the therapist’s professional accredited body. If the Client does not have the information for such a body, the counselor should provide it.
NON-COMPETITION: Therapist shall not solicit companies or persons that are under contractual obligations with the Metacognitive Therapy AS to terminate their agreements with the Metacognitive Therapy AS. Therapist shall not directly or indirectly engage in business with Clients which Consultant has been in contact, or has been made aware of, within 1 year prior to termination of this agreement. Consultant shall not share confidential information presented to him while under contractual obligations to the Company, including trade secrets, sensitive information about employees or business contacts and competitors, as well as ideas, concepts and knowledge developed by the Company, both during and after the effective period of the Agreement. Confidential information also includes other operations and business-related matters such as contracts, clients, budgets, results and plans in relation to the company, partners and clients, and other information that may weaken the Company's competitiveness.
THIRD PARTY PROVIDERS
We cannot provide all services necessary for the successful operation of our Services by ourselves. We therefore use various providers for the purposes of offering the Services to you and improve your user experience. To make our Services simple to use, you can use it with messengers. To make our Tracker more efficient, you can also sync your data from other service providers with our Tracker. When you use our Services in combination with other services, you also consent to such third party’s terms of service, so please read their terms of service carefully before you start using our Services.
SOCIAL MEDIA CONTENT
We have a Facebook page, YouTube Channel, Instagram account, TikTok account and Linkedin account. We use it for linking purposes; 1) to link to our latest mental health related articles published on our Articles section; 2) to give you access to our Services; 3) to inform about our products; 4) to inform about upcoming events such as webinars and Q&As. When using any of these third-party services their respective third-party Terms of Service and Privacy Policies apply.
COMMUNICATION
You can communicate with us through various channels on email, and third-party social media. You accept that the individuals assigned by Metacognitive Therapy AS to supply written communique (replies, posts, etc.) are support staff and, unless explicitly indicated, are not necessarily clinical psychologists or otherwise qualified mental healthcare professionals. We reserve the right not to provide a personalized response to inquiries sent to us through these various methods of communication.
EMAIL: You can contact us for general inquiries through the following email address: hello@metacognitivetherapy.com. We use Google Workspace for processing your inquiries. Replies are sent through either Google Workspace or Zendesk. For more information about the usage and data storage please read our Privacy Policy.
TRANSACTIONAL EMAIL: When you have signed up to receive correspondence from us on your email the subsequent transactional emails will be sent through the services of ActiveCampaign. The bottom of each email sent through Convertkit contains a hyperlink which allows you to set your preferences regarding the frequency of transactional emails you wish you receive. If you believe that you are faultily receiving these transactional emails, or otherwise wish to be unsubscribed you can send an email to hello@metacognitivetherapy.com subject: unsubscribe body: [your email address]. WEBFORMS: You can send us a message through various embedded web-forms located on our website. We use Webflow for retrieving form submissions, and use n8n to process route requests to the correct destination. The requests are finally handled in Google Workspace. SOCIAL MEDIA INSTANT MESSAGING: You can communicate with us through various social media platforms including Instagram, TikTok, Facebook Messenger and Linkedin. For more information about the usage and data storage please read our Privacy Policy.
LANDING PAGES: The landing page https://metacognitivetherapy.com is served through the hosting services of Webflow, Inc. For more information about the usage and data storage please read our Privacy Policy.
CLOUDFLARE: The DNS routing service that point the domain name metacognitivetherapy.com to the servers of Webflow are provided by Cloudflare, Inc. For more information about the usage and data storage please read our Privacy Policy.
PAID PROMOTION: We use Google Ads, Facebook Leads and Linkedin Ads to promote our content, product and Services. By submitting your contact information you will subscribe to receiving the selected content and we will govern the processing of this data as described in our Privacy Policy.
DATA STORAGE AND PROCESSING: We use Google Cloud services, Google Firebase and Google Workspace office solutions for operations and storage of information. Locations of storage of data are the European Union, Norway, and the US. For more information about the usage and data storage please read our Privacy Policy.
LOG IN ACCOUNTS: Login credentials. By signing up to our Services you will receive login credentials by email which you can use to access gated content and content that is exclusively tailored to you. Upon receiving your username and password in plain text. You will be instructed to change this password at the first opportunity to a phrase that is only known to you to avoid unauthorized access of your account. It is your responsibility to change this password.
INTERNAL AND EXTERNAL COMMUNICATIONS: We use different third party providers for internal and external communications. These are further specified in our Privacy Policy.
We use different third party providers for project management and project data storage:
Google drive and Clickup.
YOUR OBLIGATIONS
You hereby confirm and agree: a) that you have read and understood these Terms in full; b) that you will use our Services in accordance with these terms; c) that you are at least 18 years of age; d) that you are legally able to enter into a contract; e) that all the information that you provided in or through the Services is accurate, true, current and complete; f) that you bear responsible for maintaining the confidentiality of your password and any other security information related to your account; g) that you will notify us immediately about any unauthorized use of your Account or any other concern about a breach of the security; h) that except to the extent as expressly permitted herein, your use of our Services is for personal use only, all in accordance with these Terms; i) that you are solely and fully liable and responsible for any activities or omissions that are made by or due to using our Services; j) that we will hold you liable and responsible for any damage or loss incurred as a result of the use of your Account by any person whether authorized by you or not, and you agree to indemnify us for any such damage or loss; k) that you will not to violate any applicable local, state, national or international law, statute, ordinance, rule, regulation or ethical code in relation to your use of the Services and your relationship with us; l) that you will comply with local laws and health and safety requirements when using our Services.
Except to the extent as expressly stated to the contrary herein, your right to use the Services is personal to you and you are not allowed to give this right to another person or to sell, gift or transfer your Account to another person. Your right to use the Services does not stop us from giving other people the right to use the Service. As part of our Services, we allow you to download our Services for use on your mobile/computer device for the sole purpose of accessing and using our Services in accordance with these Terms and we grant you a non-exclusive, personal, non-transferable license for this sole purpose.

You agree that all confidential information, copyright and other intellectual property rights in our Services or any portion of the Services belong to us or the people who have licensed us to use those rights. You agree that you have no rights in or to our Services or any portion of the Services other than the right to use them in accordance with these Terms.
The materials and content comprising the Service belong to us or the people who have licensed them to us and we give you permission to use these materials and content for the sole purpose of using the Service in accordance with these Terms.
Unless allowed by these Terms and as permitted by the functionality of the Service, you agree not to: a) copy any portion of the Services; b) give or sell or otherwise make available any portion of the Services to anybody else (c) change any portion of the Services in any way, (d) look for or access the code of any portion of the Service that we have not expressly published publicly for general use. When using our Services you agree not to (a) circumvent, disable or otherwise interfere with any security related features of the Service or features that prevent or restrict use or copying of the content accessible via the Service; (b) create more than one account on the Service (however, you may connect all your social networks or other services accounts, that we support, to your account on the Service); (d) give any false or misleading information in your account details; (e) permit another person to use the Service under your name or on your behalf unless you are a business and such person is authorized by you; (f) use the Service if we have suspended or banned you from using it; (g) engage in any illegal or unlawful conduct; (h) modify, interfere, intercept, disrupt or hack the Services, our servers, network or infrastructure; (i) misuse the Service by knowingly introducing viruses, Trojans, worms, logic bombs or other material which would harm the Service or any user of the Service's own equipment; (j) collect any data from the Service other than in accordance with these Terms of Service; (k) submit or contribute any information or commentary about another person without that person's permission. Our Services are apps embedded on different operating systems. You agree not to use our Services in any other way than through our unmodified official client software (apps and web app).
Failure to comply with any of the requirements of these Terms constitutes a serious breach and may result in our taking all or any of the following actions (with or without notice): (a) immediate, temporary or permanent withdrawal of your right to use our Service; (b) issuing a warning to you; (c) legal action against you including proceedings for reimbursement of all costs (including, but not limited to, reasonable administrative and legal costs) resulting from the breach; (d) disclosure of such information to law enforcement authorities as we reasonably feel is necessary. These actions are not limited and we may take any other action we reasonably deem appropriate.
We are constantly updating and improving the Services to try and find ways to provide you with new and innovative features and services. Improvements and updates are also made to reflect changing technologies, tastes, behaviors and the way people use the Internet and our Services. In order to do this, we may need to update, reset, stop offering and/or supporting a particular part of the Services, or feature relating to the Services. These changes to the Services may affect your past activities on the Service and the features that you use. Any changes to the Service could involve your Service elements being deleted or reset.
We make our Services available for access using internet infrastructure, but are not responsible for the infrastructure itself. If you wish to use our Services, you should ensure that you have an internet-enabled device and a sufficient internet connection available. We are not liable for connection and/or technical errors such as hyperlinks not working etc.
By agreeing to these Terms, you also consent to our Privacy Policy and the platform and third party provider’s terms applicable for your usage and available in section below, all of which is incorporated and deemed a part of these Terms, together with any changes and revisions.

OUR LIABILITY AND DISCLAIMER OF WARRANTIES
You hereby agree, confirm and acknowledge that our Services and any information provided to you via our Services, whether written, stated or implied, especially including possible medical conditions in the Assessment report are for information purposes only. Any reference to a third party product or services via our Services is likewise for information purposes only. Our Services and information therein are provided ''AS IS'' with all fault and without warranty of any kind, therefore you will have no claim and demand against us.
Reliance on any information provided via our Services is solely at your own risk. We do not make, and hereby disclaim, any and all express, implied or statutory warranties, including implied warranties of condition, uninterrupted use, merchantability, satisfactory quality, fitness for a particular purpose, non-infringement of third party rights, and warranties (if any) arising from a course of dealing, usage, or trade practice. The use of our Services is at your sole risk. Our Services are not substitute for professional medical advice, diagnosis, therapy or treatment. You should never rely on or make health or well-being decisions which are based on information provided by our Services without first consulting a psychologist, psychiatrist, physician or other appropriate health professionals. If you think you may have a medical emergency, call your physician or emergency services immediately.
Some jurisdictions do not allow the exclusion of, or limitations on, implied warranties or the limitations on the applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to you.
To the fullest extent permissible by applicable law, your sole and exclusive remedy for dissatisfaction with our Services is to stop using the Services and, in no event shall Metacognitive Therapy AS, its subsidiaries or its affiliates be liable to you: a) for death or injury: b) any damages that are not foreseeable or, even if foreseeable, not directly related to our breach of these Terms or our negligence: c) any personal injury, damage, lost profits, lost revenues, cost of substitute Services, loss of data, loss of goodwill, work stoppage, computer failure or malfunction: d) any other form of direct or indirect, special, incidental, consequential or punitive damages from any causes of action arising out of or related to our Services, including any information provided to you or lack of those in connection with the Services: or e) any action or inaction by you resulting from the information we have or have failed to provide to you, whether arising in tort (including negligence), contract, strict liability or otherwise and whether or not Metacognitive Therapy AS has been advised of the possibility of such damage. In no event will we be liable to you resulting from your interaction with any third party or third party technology in connection with our Services.
Some jurisdictions do not allow a limitation of liability for death, personal injury, fraudulent misrepresentations or certain intentional or negligent acts, or violation of specific statutes, or the limitation of incidental or consequential damages, so some or all of the above limitations of liability may not apply to you. Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by laws of the Kingdom of Norway. This Agreement is governed by, and is to be construed in accordance with, laws of the Kingdom of Norway.
In addition, in no event will we be liable to you for anything resulting from your interaction with any third party or third party technology in connection with our Services and no agency relationship exists between us and any such third party.
Subject to this section, our total liability for all losses you suffer arising from, or in connection with, the use of our Services shall be no greater than the amount paid by you for the use of our Services.
INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Metacognitive Therapy AS and its employees, contractors, officers, and directors from any and all claims, suits, damages, costs, lawsuits, fines, penalties, liabilities, expenses (including attorney fees) that arise from your use or misuse of our Services, violation of these Terms, or violation of any rights of a third party. Metacognitive Therapy AS reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate in asserting any available defenses. You agree that a breach of these Terms will cause irreparable injury to Metacognitive Therapy AS for which monetary damages would not be an adequate remedy, and Metacognitive Therapy AS shall be entitled to seek equitable relief in addition to any remedies it may have hereunder, or at law without a bond, other security, or proof of damages.
ENDING OUR RELATIONSHIP
If at any time, you do not feel that you can agree to these Terms or any changes made to the Terms, you must immediately stop using the Service.
We may immediately end your use of the Services if you breach these Terms or applicable legislation. We may also withdraw the Service at any time, if we give you reasonable notice that we plan to do this.
If you or we end your use of the Services, or we withdraw the Service as described in this section, we may delete any information we hold about you. You will also lose any rights you have to use the Service or access our content. We will not offer you compensation for any losses.
FINAL PROVISIONS
These Terms incorporating Privacy Policy constitute the entire agreement between you and Metacognitive Therapy AS with respect to the Services, and they supersede all prior or contemporaneous understandings regarding such subject matter. No amendment to, or modification of, these Terms will be binding unless made in writing and signed by Metacognitive Therapy AS. No failure to exercise, and no delay in exercising, on the part of either party, any right or any power hereunder preclude further exercise of any other right hereunder.
We will occasionally update these Terms as necessary, to protect our users, furnish current information and respond to legal and technical changes. Because we are constantly adding new services and features, we might not make an immediate upgrade to the Terms, except in the case of material changes to our practices. The most current version of the Terms will govern your use of our Services and we encourage you to periodically review it. It is available within the ''Legal'' section on our Site. While you are using our Services it is your responsibility to periodically check the Site for revision updates of the Terms. Your continued usage of the Services after the changes become applicable constitutes your acceptance of the changes.
If any provision of these Terms is illegal or unenforceable under applicable law, the remainder of the provision shall be amended to achieve as closely as possible the effect of the original term and all other provisions of these Terms shall continue in full force and effect.
The original version of these Terms is written in English. Any translation into any other language is done for local requirements and in the event of a dispute, inconsistency or discrepancy between English and any non-English versions, the English version shall govern, to the extent not prohibited by local law in your jurisdiction.
These Terms, and any non-contractual obligations, and all disputes or controversies arising out of or relating to these terms shall be governed by, and construed in accordance with, laws of the Kingdom of Norway, excluding its conflict of laws rules.
